Divorce Types

1
Joint Petition Divorce
A Joint Petition Divorce is the simplest, fastest, and most affordable divorce option. Commonly referred to as an "uncontested divorce", because neither party is contesting the facts surrounding the divorce, both parties agree to all terms stipulated in the petition. Each party is in agreement with the dissolution of the marriage.
A joint petition is signed by both parties because both parties are in agreement with the stipulations of the divorce, such as alimony, child support, visitation, the division of debt and assets, etc. if applicable (each case is different). Because both parties have signed the joint petition, the divorce can be finalized fairly quickly with no need for long and drawn-out mediation, meeting and conferring with the judge, or trial.
*Filing fees are not included. You may qualify for a filing fee waiver by the court.

Contested Divorce
A Contested Divorce is a divorce where only the petitioner may end up signing because the defendant (the other spouse) did not respond to the complaint for divorce. This is a longer divorce process and can take a lot of time if the parties have to go back and forth to court and mediation to reach an agreement. Initially, the responding spouse will be served with a complaint, which they'll have to respond to within a specified timeframe. If they do not respond to the complaint, they will be in default. If they do respond and both parties agree to the stipulations, the divorce can move fairly quickly. If both parties cannot agree they may have to go to trial whereby the judge makes a binding decision on their behalf
*Filing fees are not included. You may qualify for a filing fee waiver by the court.

Default Divorce
A Missing Spouse Divorce commonly referred to as a "publication divorce” occurs when you do not know your spouse's location. The time frame for a publication divorce can take a lot of time. When your spouse cannot be found a complaint is filed, served, and mailed to their last known address. Next, an affidavit of due diligence must be completed demonstrating you've exhausted all attempts to locate your spouse, via social media, background searches, contacting their known relatives, friends, and or colleagues, etc., and still cannot locate them. Next, the judge will sign an order for service by publication. You will be required to run a legal notice, and if there is no response, you'll then proceed to divorce your spouse by default.
*Filing fees are not included. You may qualify for a filing fee waiver by the court.
